Terms of Service

These terms govern the use of the SMSJet platform. By using the service you fully accept the conditions below.

The service

SMSJet provides an API for sending transactional and promotional SMS and WhatsApp templates, backed by a prepaid EUR balance shared by both channels. The service is intended exclusively for business customers and is not meant for consumer use.

Invitation-only accounts

There is no self-signup: accounts are provisioned by our team on an invitation-only basis. Access credentials are sent by email to the address given during activation. You are responsible for keeping your credentials safe and for every activity carried out through your account.

Pricing

Prices are fixed, expressed in EUR per message part, and exclude VAT. The live price list for each destination is always available in the dashboard.

A message may be split into up to 4 parts: 160 GSM-7 characters for a single message, 153 per part for concatenated messages, and 70 and 67 respectively for Unicode messages.

Payments

Balance top-ups are made by invoice only: no card payments are available. The balance is prepaid, is not transferable to other accounts, and is debited when each message is sent.

Customer obligations

  • Use the service only for lawful purposes and in compliance with applicable law.
  • Ensure you have the recipients’ consent, where required, before sending.
  • Do not send spam or unsolicited or misleading messages.
  • Do not use sender IDs that impersonate third parties or mislead recipients about the origin of the message.

Service limits

  • SMS is one-way: recipient replies are not delivered back. WhatsApp replies are available in the dashboard inbox.
  • No sandbox environment is available.
  • The API is synchronous and subject to per-account rate limits.

Availability

The service is provided on a best-effort basis, with no service level agreement (SLA). Routine or extraordinary maintenance may cause temporary interruptions; where possible, scheduled maintenance is announced in advance.

Liability

Our aggregate liability is capped at the amounts you paid for the service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect damages, loss of profits or opportunities, or for delivery failures attributable to carriers or the network.

Changes

We may update these terms over time, for example to reflect legal developments or the evolution of the service. Material changes are announced via the dashboard or by email with reasonable notice. Continued use of the service after the changes take effect constitutes acceptance.

Governing law

These terms are governed by Italian law. Any dispute arising from the contract or from the use of the service falls under the exclusive jurisdiction of the Italian courts.
